"In January 2016 you kindly referred a Residential Care Home (East Grinstead) who were unhappy with their solicitor and who were defending an Employment Tribunal action raised by a former employee. This included claims of unfair dismissal and whistle blowing.

I am pleased to be able to report that we had the Tribunal Judge’s Judgment yesterday, and in effect, the care home won the case.  The Judge determined that the dismissal had not been unfair and the whistle blowing claim was dismissed."

Following NCA assistance after CQC inspection:

The background work by The NCA leading to the direct contact with CQC was undoubtedly a key factor in the process.  This joint working and fighting of common causes is a testament to the NCA itself and the passion and commitment shared by members in promoting the best principles in health and social care.  Where funding is increasingly scarce yet regulatory requirements are ever more demanding it is imperative that providers challenge what they perceive as unfair requirements and judgements.  For providers to do so using the expertise and influence of the NCA sends a positive, consistent and coordinated message and fights for consistency in regulatory approaches and justice for the small fish in the big pond!”
